Terms and Conditions

These terms explain how customers, guests, restaurants and Near Choice should use the platform during ordering, account verification, offers and testing-stage service.

1. Acceptance

By creating an account, continuing as guest, verifying OTP, clicking an email verification link, placing an order or using Near Choice, you agree to these Terms and Conditions. If you do not agree, please do not create an account or place an order through the platform.

2. Testing-stage platform and charges

Near Choice is currently running as a testing-stage project. At this stage, we are not charging any extra platform amount, subscription amount or commission from restaurants or customers for using Near Choice.

Restaurant bill amounts, taxes, packaging charges, delivery charges, convenience charges or other clearly displayed charges may still apply when relevant. If Near Choice introduces any platform fee or commercial charge in the future, it should be communicated in the platform experience before use.

3. Images, menu and availability

Product images, banners, menu visuals and promotional graphics may be representative, edited, enhanced or AI-generated. The actual food served by the restaurant may differ in color, size, plating, garnish, packing, ingredients and presentation.

Menu items, prices, offers, preparation times, restaurant hours and item availability may change based on restaurant operations, stock, holidays, demand, location, staff availability and other practical conditions.

4. Account, OTP and guest details

You must provide your real name, valid mobile number, correct email address and accurate delivery or dine-in details.
You are responsible for keeping OTPs, passwords and verification links private.
Do not share your account, OTP or verification link with anyone who is not authorized to use it.
Near Choice may restrict, cancel or review accounts that appear fake, abusive, automated, duplicate or unsafe.

5. Restaurant responsibility

Near Choice helps customers discover restaurants and place order requests. The restaurant is responsible for food preparation, ingredients, taste, quality, hygiene, packing, quantity, item availability, order acceptance and final service.

Delivery, pickup and dine-in timing shown on the website is an estimate. Actual timing may vary due to restaurant load, traffic, weather, preparation complexity or operational delays.

6. Orders, cancellation and refunds

Orders are subject to restaurant acceptance, item availability and correct customer details. Cancellation, replacement or refund handling may depend on the restaurant response, order status, payment method, preparation stage and the practical possibility of stopping the order.

Offers, coupons, free items and discounts may be limited by restaurant, time, stock, eligibility, order type and abuse checks.

7. Responsible use

Do not submit fake customer data, fake delivery addresses, abusive reviews or repeated false orders.
Do not attempt to break, scrape, overload, reverse engineer or misuse Near Choice systems.
Do not use the platform for unlawful activity, harassment, impersonation or fraud.
Near Choice may block, restrict or cancel suspicious activity to protect restaurants, customers and the platform.

8. Service changes and limitation

Near Choice is provided on an as-is and as-available basis during testing. We try to keep details accurate and service smooth, but we cannot guarantee uninterrupted service, exact content accuracy, exact pricing, exact preparation time or item availability at every moment.

These terms are written to make the platform clear and fair. They should be reviewed by a qualified legal professional before public commercial launch.
